Web Site Privacy and Security Statement

Privacy and Security

This website is owned and operated by CPS Credit Union Co-operative (ACT) Limited (ABN 31 087 649 670) ("CPS"), under the domain name www.cpsact.com.au ("the website").

This statement applies to all CPS products, services and facilities hosted on the website.

As a credit provider, CPS complies with Part IIIA of the Privacy Act, 1988 ("the Act"). As from 21 December 2001, CPS must also comply with 10 National Privacy Principles applicable to private sector organisations. We take these privacy obligations very seriously. We have implemented several security measures to protect information that you submit to us via the website. These measures are explained in more detail below.

We suggest that you read this complete statement now, and from time to time check the site for updates and amendments.

Collecting Statistical Information

CPS tracks visitors to its site for statistical purposes and as a result, if you visit the site, our online statistical package will record the following:

  • the country you are viewing the website from;
  • the operating system you are using;
  • the browser you are using;
  • which domain you are from;
  • the hour of the day you visit our site;
  • the day of the week you visit our site; and
  • the pages which you view.

The information is purely statistical and we do not record anything in this regard that could identify any specific individual.

We offer various interactive facilities on the web site and we may introduce more in the future, and these may require entry of personal information.

Personal Information Supplied By You To CPS

The personal information you supply will be used for identification purposes and is necessary for you to register as a user of CPS Internet Banking, to apply for a loan online, or to submit a feedback form.

Should the product or service require you to supply information about yourself to CPS you agree that you shall:

  • provide true, accurate, current and complete information about yourself as requested; and
  • maintain and promptly update the information to keep it true, accurate, current and complete.

You can do this by using the secure feedback form available on the web site or alternatively by informing staff at any CPS office.

Collection of Personal Information

Our online collection of personal information is limited to information provided as part of on-line loan applications and member feedback forms. Both these functions utilise secure transmission methods, involving 128 bit encryption and digital certificates. We recommend that users do not transmit any personal information to CPS by email, as there are inherent risks in transmitting personal information in this way.

Cookies

The website uses "session cookies". These are small files that are stored in temporary memory, and erased when the browser is closed. They are simply used to enable our site to track the pages that the user has seen during a visit. They do not contain any personal information whatsoever.

Using and Disclosing Your Personal Information

The Act places restrictions on the disclosure of personal information to third parties. We will comply with these restrictions and by the other terms in this Privacy Statement.

As you may expect, CPS contracts out a variety of services, and some of these contractors act on our behalf to deliver products and services to members. These contractors may include, amongst others, valuers, insurance companies, financial planners, mail houses and mercantile agents. It may be necessary for us to provide personal information to these and other contractors in order to provide you with our products and services. We may also disclose your personal information to external advisors, including Credit Union Services Corporation (Australia) Limited.

We may also disclose your personal information to third parties if authorised or required to do so by law. Examples would include disclosure of information pursuant to a court order, disclosure required by legislation (e.g. the Financial Transactions Reports Act, 1988 requires us to report certain financial transactions to Austrac) or disclosure if we reasonably believe it to be necessary to prevent or prosecute criminal offences.

CPS may share your information with an associated entity (such as Credit Union Services Corporation (Austrlaia) Limited) or service provider (such as an insurance underwriter) of CPS but will not use or disclose any personal information that you have provided to us, to any unauthorised Third Party without your consent, or allow access to your communications on our Website to an unassociated Third Party, unless:

  • CPS is authorised, required or permitted by law to disclose the information; or
  • You have authorised us to do so; or
  • We have given you notification of the intended use or disclosure and you have not objected to that use or disclosure; or
  • We believe the use or disclosure is reasonably necessary to assist a law enforcement agency or agency responsible for national security in the performance of its duties; or
  • We believe that the use or disclosure is reasonably necessary to protect the rights or property of CPS, and CPS staff, or any member of the public.

We undertake that we will not, under any circumstances, sell our database of member contact details to any organisation.

Accessing Your Information

From 21 December 2001, and subject to the exemptions set out in the Act, you are entitled to access any personal information that we hold in relation to you. If at any time you wish to access the personal information we hold about you, you are welcome to submit a written request. A copy of the relevant form is available by clicking here. This form must be personally signed by you and mailed or delivered to CPS.

Correcting Incorrect Information

If your consider that any personal information we hold about you is not correct, accurate, complete or up to date, we will review your claim and if necessary amend our records to reflect the true situation.

Where there is a disagreement between CPS and you about the accuracy of your personal information, you may ask us to note your views on our records and we will take reasonable steps to do so.

Cost of accessing your personal information

We will charge you for the provision of information requested by you. The fee will be based on the time spent by a CPS employee to retrieve the requested information plus archive retrieval, copying and any other associated costs. We will then provide you with an estimate of the expected fee to retrieve and provide the information that you requested. You will than authorise us to proceed with the collection and provision of information.

The fee may be applied on a full cost recovery basis, and may be considerable if a large amount of searching is required to access the information requested.

Timeframe for processing privacy requests

Generally, we will attempt to fulfil requests for information within 14 working days of receiving your written request, although complex requests involving considerable archive retrieval may take up to 30 working days. We will advise you at the time of the fee estimation of the anticipated timeframe.

Direct Marketing

In addition to the regular information that you receive as a result of being a member of CPS, we may wish to also send you material concerning new or additional products and services offered by CPS. However, we acknowledge that you may prefer not to receive certain direct marketing material. We have designed a form that allows you to opt-out of emailed and/or posted direct marketing communications. If you do not wish to receive marketing or promotional material from CPS via email and/or post, please inform us via our secure feedback form.

Amendments to CPS’ Web Site Privacy Statement

CPS Credit Union reserves the right to amend this Privacy Statement from time to time and we will publish any such amendments on the site. Amendments will be effective immediately upon posting on the website. This Privacy Statement was last amended on 12 December 2001.
